Now that you have experienced how the industry works, that is, assisting clients and customers achieve their objectives, it’s time to look once again at the basic tenants of the law and how they work into your daily activities.

The 45-hour post license course is a review of the aspects of the law as it affects the aspects of doing business. The program is broken into 3 segments with each segment targeting a specific component of law intended to enhance your comprehension and application for the benefit of your client.

  • APPLIED BROKERAGE PRINCIPLES (15-hours)This program is dedicated to reviewing the various components of the law in order to reinforce what you as a licensee are supposed to be aware of and protecting the interests of your client. You will cover such aspects as:Sponsoring broker responsibilities ◊ Areas of practice◊ Brokerage agreements◊ Designated & dual agency◊ Escrow ◊ Working within a team◊ Types of properties including commercial industrial & special-purpose ◊ Various types of brokerage◊ Tax impact on the real estate◊ Business planning including the setting of goals ◊ Budgeting ◊ Time management◊ Technology ◊ Laws impacting your ability to communicate with the consumer◊ Prospecting ◊ Professional conduct ◊ Advertising practices◊ Responsibilities to your client◊ General market knowledge including use of the CMA, appraisal standards and publicly available information
  • RISK MANAGEMENT/DISCIPLINE (15-hours) This program looks at various aspects of the law that can create circumstances which put a licensee and the consumer at risk. The program encompasses a discussion of the various aspects of the law along with interactive discussion involving various case studies. You will cover such aspects as:Fair housing application ◊ Antitrust issues ◊ Escrow accounts ◊Insurance ◊ Compliance with basic office policies◊ State and federally required disclosures◊ Recognizing sexual harassment ◊ TRID – RESPA & TILA◊ Unauthorized practice of law◊ Safety issues – issues regarding involvement with the consumer◊ Wire fraud & cyber-crimes◊ IDFPR procedures & disciplinary action.
  • TRANSACTIONAL ISSUES (15-hours) This program looks at issues the licensee might encounter when dealing with the client and members of the general public. The intent is to reinforce the licensee’s understanding of what is expected of them and how they are expected to approach the business. You will cover such aspects as:Seller issues ◊ Listing agreements◊ Compliance with the law relative to dual agency & agency disclosure◊ Property disclosures required for both buyer and seller◊ Environmental issues such as radon◊ Lead paint disclosure◊ Floodplains ◊ Marketing ◊ Use of electronic media as a means of solicitation◊ Disclosure of status as a licensee◊ Showing properties◊ Cooperating with other brokers◊ Contract issues including counteroffers & multiple offers◊ Selling properties “as-is”◊ Finance issues◊ Evaluating & advising the client offers in counteroffers◊ Buyer issues◊ Providing notice of No agency◊ Buyer brokerage agreements◊ Contract issues affecting the buyer◊ Contingency issues pace that commercial/industrial property management
